1. THE KINETIC ALLIANCE:
By engaging Kinetic Digital, you are not hiring a freelancer; you are retaining a specialized engineering unit. Our output is defined by the "Scope of Works" (SOW) document issued at the project commencement. Any requests falling outside this SOW will be classified as "Scope Creep" and billed at our standard hourly rate of €150/hr.
2. INTELLECTUAL PROPERTY (IP) TRANSFER:
This is the core of our Ethos. Unlike agencies that hold you hostage, we believe in Full Transfer of Title. Upon settlement of the final invoice, 100% of the Copyright, Source Code, and Design Assets transfer explicitly to The Client. We retain only a non-exclusive right to display the work in our portfolio (The "Architectural Logs"). You own the machine. We just built it.
3. PAYMENT PROTOCOLS:
We operate on a milestone basis to mitigate risk for both parties. Standard deployment terms are: 50% Mobilization Fee (to book the slot) and 50% Deployment Fee (prior to live server push). Late payments exceeding 14 days will incur a suspension of services and a statutory interest charge of 8% above the ECB base rate.
4. LIMITATION OF LIABILITY:
While we engineer for resilience, the web is a volatile environment. Kinetic Digital accepts no liability for revenue loss caused by: Third-Party API failures (e.g., Stripe going down), Hosting outages (AWS/Netlify failures), or acts of God. Our liability is strictly capped at the total value of the invoices paid by the client in the preceding 12 months.

1. THE COOKIELESS FUTURE:
Kinetic Digital is aggressively preparing for a cookieless web. We prioritize Server-Side Tracking over client-side cookies. However, for current operational continuity, we utilize specific "Local Objects" to facilitate user experience.
2. ESSENTIAL TOKENS (NON-NEGOTIABLE):
These scripts are required for the physics of the site to function. They handle: Security Tokens (CSRF protection), Load Balancing (Cloudflare routing), and Preference Storage (remembering you closed the popup). You cannot opt-out of these without breaking the site architecture.
3. ANALYTICAL PROBES (OPTIONAL):
